Please find below my terms and conditions. You should read them carefully and print out a copy for your future reference. Please note that my commitment to customer satisfaction and my reputation is of utmost importance to me and I will always endeavour to ensure you are satisfied with my service, as far as possible. By paying your deposit it will be deemed that the terms and conditions are understood and accepted as applying to your order.
YOUR QUOTATION AND ACCEPTANCE
You will receive a quotation detailing your wedding cake or celebration cake design and all relevant information via email. Please confirm the details are correct by return email, along with your non-refundable deposit. All orders are subject to acceptance by myself and I will confirm acceptance of date via email and send you a confirmation for any monies paid. All prices are non-negotiable and priced according to your exact design and the size of your cake.
PORTION GUIDE
Portion guides are intended as a guide only. This will vary dependent upon how you or the venue staff cuts the cake.
DEPOSIT AND PAYMENT
The price of your cake will be detailed in your quotation and anydelivery/setup charges (if required) will also be shown. Full payment is due in cash or cleared funds, such as bank transfer, at least 4 weeks before the delivery or collection date as shown in your quotation for wedding cakes and on or before collection of your celebration cake. Prices are liable to change at any time, but any changes will not affect orders which I have already accepted. Dates will be held once your deposit is received. Quotations should be accepted within one month or will lapse.
FRESH FLOWERS
If your cake requires fresh flowers, I am happy to liaise with your florist.Please note, Art of Cake by Sylvia cannot be held responsible for any problems with your fresh flowers, (such as the presence of insects or wilting). I cannot take responsibility for any damage rendered to the cake caused by a floral arrangement if it was implemented by your florist, but I am very happy to ‘dress’ your cake with the floral arrangements myself. If fresh flowers are used, the cake will be set-up as late as feasibly possible to ensure their freshness throughout the day. Depending on the varieties of flowers used & the weather conditions at the time, it may be necessary to cut the cake relatively early on in the proceedings to ensure their freshness for the photography.
ALTERATIONS AND CHANGES
Each cake is made individually by hand, so although every effort is made to ensure consistency, a small amount of variation may occur from the design
requested / picture supplied. Changes to the design, specification and flavour of your cake may be possible up to 4 weeks before your wedding date. However if handcrafted sugar flowers and/or models/toppers have been requested, some or all of these may have already been made, and it may not be possible to change these details. Please call to discuss any alterations and price implications that a change may create. Any changes must be specified by you in writing. Please note that any alterations may increase the price of your cake. This will be confirmed by myself to you in writing or email.
DELIVERY OR COLLECTION
Celebration cakes are to be collected from my addressat 20 Beaufort Road, St Leonards on Sea, East Sussex TN37 6QA. Full payment must be made in cash on collection, or by cleared funds such as bank transfer, before collection.However, if your cake has several tiers it may be possible for me to deliver and set up at your home/venue. I can quote for this service if required.
I am able to deliver and setup your wedding cake to venues within a 35 mile radius of Hastings. This is advisable for all wedding cakes. However if you prefer to collect your cake, this is also possible. You (or a representative for you) will be asked to sign a confirmation form upon collection or on delivery and set-up of the cake. Please note that I cannot be held liable for any damage made to the cake after this time; including transportation, storage or inadequate placing after delivery. Full payment must have been received by myself in cash or cleared funds to ensure that your wedding cake is available for collection or delivery.
CAKE SETUP
It is the clients’ responsibility to ensure arrangements are made for the cake table, linen, cake stand (if not hired from Art of Cake) & knife, which should all be set- up prior to my arrival. If any delay is incurred due to these not being set-up, I reserve the right to charge for any delay incurred (labour / time costs at £20 per hour). Alternatively, please arrange for the cake to be left with the event manager to assemble / move into position as appropriate. (It is advisable that the cake is moved as little as possible once it is set up). Please take extra care to ensure a stable cake table is available if you are having a marquee wedding, as surrounding floorboards can easily rock the cake when stood on, and the ground outside may be uneven. Art of Cake by Sylvia cannot be held liable for damage to your cake due to uneven surfaces or unstable display tables.
HIRE OF CAKE STANDS / ACCESSORIES
If you would like to hire a cake stand or decorations, then a deposit is required prior to release. Deposit amounts vary dependant upon the value of the item being hired. Please make arrangements to ensure items hired are safely returned to myself within 7 days of the cake delivery /collection. Once I receive the hired item back I will refund the deposit held, subject to no breakages/damage etc.I am happy to set up your cake on a stand that you or your venue provide, with the proviso that I consider it to be an appropriate size and sturdy enough for your cake. However, Art of Cake by Sylvia cannot be held responsible for any damage to your cake, caused by collapse of a cake stand that you or your venue have provided.
STORING YOUR CAKE
After delivery or collection, you must ensure that your cake is kept out of sunlight and at room temperature. Cakes with sugarpaste should not be put in a refrigerator. Care should be taken to place cakes in marquees as close to guest arrival time as possible, as marquees become very warm on hot days. Stacked cakes will be supported by plastic dowels or straws, which should be removed prior to serving. Any elements of your cake which are not edible will be clearly highlighted on your advice form. I ask you to ensure that these are removed prior to serving. The Art of Cake cannot take any responsibility for accidents which may occur through neglecting to remove the non-edible items.
FOOD ALLERGIES
All cakes are produced in a kitchen where nuts, flour (gluten) and dairy products are used. I cannot guarantee that traces of these ingredients will not be in a cake. Your advice form will include allergy advice for the cakes you have ordered. This form will be given to you when you collect the cake, or left with staff at your venue.
CANCELLATIONS
If you need to cancel your order, the deposit paid is non-refundable. This is because I will have turned away further orders for the date which you secured with your deposit.
MY LIABILITY
My liability to you is limited to the price of the cake and I cannot be held responsible for any indirect losses which may happen as a consequence of any breach by myself of these terms however arising. However, this does not include or limit in any way my liability for any matter for which it would be illegal for me to exclude, or attempt to exclude, my liability.
EVENTS OUTSIDE MY CONTROL
Art of Cake cannot be liable or responsible for any failure to perform, or delay in performance of, any of my obligations under these terms that is caused by any act, event, non-happening, omission or accident beyond my reasonable control. (For example, a road traffic accident/road closure that delays delivery of your cake).
REVISIONS TO THESE TERMS AND CONDITIONS
I have the right to revise and amend these terms and conditions. However, you will be subject to the terms and conditions in force at the time that you place your order with myself.
LAW AND JURISDICTION
These terms and conditions will be governed by English law.
